Terms of Service

These Terms of Service ("Terms") govern your use of builder77.com, the builder77 builder, the builder77 runtime and hosting services, and related services (together, the "Service").

The Service is provided by Hüseyin Can Bayram, sole proprietorship (şahıs işletmesi) operating builder77, Mithatpaşa Cd. No: 7, 41001 İzmit / Kocaeli, Türkiye ("builder77", "we", "us"). Contact: contact form · [email protected]. See our Legal notice.

By creating an account or using the Service, you agree to these Terms. If you use builder77 on behalf of an organization, you agree on its behalf and confirm you have authority to do so.

1. Your account

• You must be at least 13 years old to use builder77. If you are under the age of digital consent in your country (between 13 and 16 in the EU, depending on the country) or under the age of majority where you live, you may use builder77 only with the permission of a parent or legal guardian, who agrees to these Terms for you. Children under 13 may not use builder77; if we learn that an account belongs to a child under 13, we delete the account and its data.
• Provide accurate information and keep your password secure. You are responsible for activity on your account.
• One person or organization per account. Don't create accounts to abuse free credits or referral bonuses.
• Tell us right away through the contact form if you suspect unauthorized access.

2. The Service

builder77 lets you create websites, web apps and mobile apps by describing them in natural language, edit them through chat or code, and host them with a built-in database, authentication, file storage, email and AI features. We continuously improve the Service and may add, change or remove features. If we remove a material paid feature, we'll give reasonable notice.

3. Credits

• Message credits are used when you ask builder77 to build or change something. Most messages use 6 credits; premium options may use more, as shown in the builder before you send. Some actions, like converting an app to Flutter, use a stated number of credits.
• Integration credits are used when your published apps call built-in services such as AI, file uploads or email. Database reads and writes, authentication and hosting do not use credits.
• Monthly plan credits reset each billing period and do not roll over. Free plans may also have a daily limit. Purchased credit packs and bonus credits (such as referral bonuses) are added to your balance as described at the time of purchase or award.
• Credits have no cash value, are not transferable and cannot be exchanged for money, except where required by law.
• We may remove credits obtained through fraud, abuse, self-referrals or technical errors.

4. Subscriptions, prices and payment

• Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled.
• You can cancel at any time from your account. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Publishing and hosting. You can publish apps on every plan, including Free (a verified email address is required), on a builder77.app address. Apps on the Free plan show a "Made with builder77" badge; connecting your own domain and removing the badge require a paid plan. If your paid plan ends, your published apps stay online on their builder77.app address, subject to these Terms, and the badge returns; a connected custom domain stops serving your app until you subscribe again. Your projects and data are not deleted because a plan ends.
• You can switch plans, monthly or yearly, from your account at any time. The new plan starts immediately, and the unused part of your current plan is refunded pro rata to the original payment method or, if a refund isn't possible, added to your balance as message credits. The unused part is the remaining time of the paid period, reduced by the share of the current month's plan credits already used.
• Prices are shown in the currency of your country (Turkish lira in Turkey, euros in the EU/EEA and Switzerland, US dollars everywhere else) and include VAT or sales tax where it applies; the final amount is shown at checkout before you pay.
• We may change prices with at least 30 days' notice. Changes apply from your next renewal after the notice period, and you can cancel before then.
• If you are a minor, you may make purchases only with the permission of a parent or legal guardian. For purchases in the mobile app, the family and purchase settings of your App Store or Google Play account (for example Ask to Buy or purchase approvals) apply.
• Web purchases are processed by our payment provider Whop. If a payment fails, we may suspend paid features until it is resolved.

• Plans and credit packs bought in the builder77 app for iPhone or Android are sold and billed by Apple (App Store) or Google (Google Play) through your store account, at the price and in the currency the store shows before you confirm. They give you the same plan, credits and features as the same purchase on the web.
• Automatic renewal. In-app subscriptions renew automatically at the end of each period (monthly or yearly) at the then-current price, unless automatic renewal is turned off at least 24 hours before the end of the current period. Your store account is charged for the renewal within the 24 hours before the period ends.
• Cancelling and changing plans. You manage and cancel in-app subscriptions in your store account (iPhone: Settings → your name → Subscriptions; Android: Google Play → Payments & subscriptions → Subscriptions) or from the Plans screen in the app. Cancellation takes effect at the end of the current period and you keep the plan until then. Deleting the app or your builder77 account does not cancel a store subscription. Switching plans follows the store's rules for upgrades, downgrades and proration.
• Refunds of in-app purchases are decided by Apple or Google under their refund policies (Apple: reportaproblem.apple.com; Google: the refund request in Google Play). The money-back guarantee in section 5 applies to web purchases. If a store refunds a purchase, we remove what it gave you (the plan, or the remaining credits of a pack).
• Credit packs bought in the app are consumable and don't expire. "Restore purchases" restores active subscriptions on a new device; credit packs already added stay on your builder77 account.

5. Refunds and right of withdrawal

14-day money-back guarantee. If you're not happy with a new paid subscription or a credit pack, you can request a full refund within 14 days of purchase through the contact form, using your account email, as long as you have used no more than 20% of the purchase (for a plan, 20% of its monthly message credits; for a credit pack, 20% of the pack's credits). Subscription renewals and domain purchases are not covered. Apart from this guarantee and plan switches (see section 4), payments are non-refundable except where required by law. We may also decline requests that show clear abuse (for example, repeatedly buying and refunding plans or credit packs). Refunds go back to the original payment method.

Right of withdrawal for consumers in the EU, EEA, UK and Switzerland. If you are a consumer, you have the statutory right to withdraw from a contract concluded online within 14 days without giving a reason. To exercise it, send us a clear statement (for example through the contact form) before the period ends. If you withdraw, we reimburse all payments received from you without undue delay and no later than 14 days after we receive your notice, using the same payment method. If you asked us to start the service during the withdrawal period, you pay a proportionate amount for what was provided until you withdrew. For credits (digital content), your right of withdrawal ends once you have expressly agreed that we start providing them immediately and acknowledged that you lose the right as soon as they are fully used. Our 14-day money-back guarantee above applies in addition to these statutory rights.

6. Your content and ownership

• You own your content. Your prompts, uploaded materials, the code and content generated for your projects, and the data stored in your apps belong to you (or your licensors), to the extent permitted by law.
• You give builder77 a limited license to host, store, copy, process, transmit and display your content only as needed to provide, secure and improve the Service for you, for example to run your app, show previews, keep version history and generate changes you ask for.
• You can export your projects at any time on plans that include export, and delete them whenever you like.
• You are responsible for having the rights to everything you upload or ask builder77 to use, including images, text, trademarks and personal data.
• The builder77 platform itself (our software, SDK, templates, brand and documentation) belongs to builder77. Templates and SDK code included in your projects are licensed to you for use within those projects.

7. AI output

builder77 uses AI to generate code, content and designs. AI output can be inaccurate, incomplete, insecure or similar to output generated for others, and it may not be unique. You are responsible for reviewing, testing and deciding whether to use AI output, especially before relying on it for anything important, such as handling payments, health, legal or financial information, or personal data. AI responses produced inside your published apps (via b77.ai) are likewise your responsibility to review and present appropriately to your users.

8. Acceptable use

You agree to follow our Responsible Use Policy. In short, you may not use builder77 to:

• break the law or help others break it;
• create phishing pages, impersonate people or organizations, or collect credentials or payment details under false pretenses;
• distribute malware or build tools designed to attack, scrape or overload other systems;
• host illegal content, including child sexual abuse material, or content that infringes others' rights;
• harass, threaten or exploit others, or promote violence or hate;
• send spam or unsolicited messages through the email features;
• circumvent rate limits, credit limits, security measures or plan restrictions, or access other users' apps or data;
• resell or white-label the Service without our written agreement.

We may remove content, unpublish apps or suspend accounts that violate these rules. You can report illegal content at /report-abuse; we review reports promptly and tell you what we decided.

9. Your apps and your users

You are responsible for the apps you publish and how they treat their users. That includes providing your own terms, legal notice and privacy notice where required, handling app user requests, and complying with laws that apply to your app (for example consumer protection, privacy and accessibility laws).

10. Third-party services

The Service relies on third-party providers (such as AI model providers, payment processors and email delivery). Apps you build may also load third-party libraries, fonts or images. Your use of third-party services may be subject to their own terms.

11. Suspension and termination

• You can stop using builder77 and delete your account at any time.
• We may suspend or terminate your access, or unpublish specific apps, if you materially breach these Terms, if required by law, or to protect the Service, our users or the public. Where reasonable, we'll give notice, the reasons, and a chance to fix the issue first.
• After termination, your right to use the Service ends. We'll give you a reasonable opportunity to export your content, unless the termination is due to serious abuse or legal reasons. Data is then deleted as described in our Privacy Policy.
• Sections that by their nature should survive termination (ownership, disclaimers, liability, governing law) will survive.

12. Availability and warranty

We work hard to keep builder77 available and working, but we can't guarantee that the Service will be uninterrupted or error-free or that generated apps will meet every requirement. Check our status page for live availability. To the extent permitted by law, the Service is provided "as is". If you are a consumer, your statutory rights regarding the conformity of digital services remain unaffected.

13. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever liability cannot be limited by law (including mandatory product liability). Otherwise, to the extent permitted by law, we are not liable for indirect or consequential damages or lost profits, and our total liability for any claim relating to the Service is limited to the greater of (a) the amounts you paid to builder77 in the 12 months before the claim, or (b) US$100. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

14. Indemnity

If you use builder77 for business purposes, you agree to defend and indemnify builder77 against third-party claims, damages and costs (including reasonable legal fees) arising from your content, your apps, or your violation of these Terms or the law.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, excluding the UN Convention on Contracts for the International Sale of Goods. For business customers, the courts of İzmit (Kocaeli), Türkiye have exclusive jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts there. Before filing a claim, please contact us through the contact form so we can try to resolve it informally. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

16. Changes to these Terms

We may update these Terms from time to time. For material changes, we'll notify you by email or in the product at least 14 days before they take effect, and you can cancel before then. Continuing to use the Service after changes take effect means you accept the updated Terms.

17. General

These Terms, together with our Privacy Policy and Responsible Use Policy, are the entire agreement between you and builder77 about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the business. These Terms are written in English; translations are provided for convenience, and the English version prevails where they differ, unless mandatory law says otherwise.
